Accountable politicians ? We are currently making a film about this very subject, 'The Fiduciary Disguise’. This film is about the endless lack of accountability by our most important fiduciaries, the politicians and judges. Both are protected by crown and judicial immunity so if they fail, we pay the price. These issues are about seriously big stakes; if they fail the entire nation is at stake. So after ruining a nation politicians and judges flush with their pensions retire and leave the people the damage. That system must be stopped. Our politicians and judges must be made accountable if they want the job of running our systems of state.
The film is in part about litigation known as Arklow vs Maclean in which both sides spent more than $10m battling over assets that today are worth billions.
The plaintiff, namely me, sued a bank that I had gone to borrow $5m from. In looking at my business planning, the bank realised I was going to make billions of dollars profit on my venture so the bank went behind my bank and did the deal for them-selves. I was pissed! From my part of town that type of dealing leads to people being woken up with shotguns. But being the proper businessman I employed lawyers, invested $5.5m to take the bank to court. I won the 4 week trial, we hammered them the cross examination, the evidence was so clear. Yet we lost the appeals, including the Privy Council.
Now fair and square loss I don't mind a loss. But the judgments we ended up with had the facts and law completely wrong. They said things that never happened. It was a sham. The Privy Council judge who wrote the judgment was a business partner of the defense. A business partner of the defendant bank was the Chief Justice's son; the list went on and on. Then to my horror, Parliament didn’t want to know about my evidence backed complaints.
And so as a self made pissed off entrepreneur, an experienced litigant, a good father and I hope a contributor to democracy, I have turned my total attention to dealing with this endless problem of idiots in power. They drive us all nuts. I have had a gutful of them and now beginning with this film I am after them. From the local council, the courts, the rules and red tape, mindless ego driven publicity hungry politicians, greedy lawyers, it affects us all everyday.
The film will outline the problems caused by crown and judicial immunity or sovereign immunity as it is known in some nations. These are the laws that come from the concept the king can do no wrong.
The good thing is we don’t just outline the problems. You all read the news and have your own stories you know the issues we have faced. The best part is we will introduce two ideas to remove these immunity laws our leaders have been hiding behind.
The first is in democracies throughout the world, memberships of political parties are thin. In New Zealand its less than 25.000 members for all the political parties combined. Grey Power and the Students Union have over 300.000 members. So by flooding existing political parties we can make it party policy that immunity is removed and our politicians and judges are accountable like the other fiduciaries who ask society to trust them. The second part you will need to see the film. But Barrack Obama has called for a change. It has needed to come, our world is in a mess and who is to blame. Any guesses?
